These Terms of Service ("Terms") govern your access to and use of the 9Teese mobile application (the "App") operated by 9Teese ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 17 years old to use 9Teese. By using the App, you represent and warrant that you are 17 or older. We reserve the right to terminate any account we believe belongs to a user under 17.
2. Account Registration
To use the App, you must create an account using a valid email address and provide accurate information including your first name and date of birth. You are responsible for:
- Keeping your account credentials secure
- All activity that occurs under your account
- Notifying us promptly of any unauthorized access at the90sapp@gmail.com
You may not create more than one account or create an account on behalf of another person.
3. Acceptable Use
You agree not to use the App to:
- Post content that is illegal, threatening, harassing, abusive, defamatory, or obscene
- Impersonate any person or entity
- Upload content depicting minors in any sexual or inappropriate context
- Distribute spam, malware, or unsolicited commercial messages
- Scrape, harvest, or collect data about other users without their consent
- Attempt to gain unauthorized access to the App or its infrastructure
- Use the App for any unlawful purpose or in violation of any applicable laws
- Stalk, harass, or threaten other users
We reserve the right to remove content and/or terminate accounts that violate these rules.
4. User-Generated Content
You retain ownership of content you post on 9Teese. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the App.
You are solely responsible for the content you post. We do not endorse any user-generated content and make no representations about its accuracy or reliability.
5. Location Services
Core features of 9Teese rely on your device's location to show you nearby users and content. By enabling location access, you consent to the App using your location as described in our Privacy Policy. You may disable location access at any time in your device settings, which will limit location-based features.
6. Messaging and Direct Communication
The App allows you to send message requests and direct messages to other users. You must obtain a user's acceptance of your message request before engaging in direct conversation. Unsolicited or harassing messages are a violation of these Terms and may result in account suspension or permanent ban.
7. Reporting, Blocking, and Moderation
You may report content or users that you believe violate these Terms. Reports are reviewed by our moderation team. We may take action including content removal, temporary suspension, or permanent ban at our sole discretion. We are not obligated to notify you of actions taken on reports you submit.
Accounts that are banned may not create new accounts. Attempting to evade a ban is a violation of these Terms.
8. Account Deletion
You may delete your account at any time from within the App's settings. Upon deletion, your profile, posts, and personal data will be removed in accordance with our Privacy Policy. Account deletion is permanent and cannot be undone.
9. Intellectual Property
All rights, title, and interest in the App — including its design, software, trademarks, and original content — belong to us. Nothing in these Terms grants you a right to use our branding or intellectual property outside the App.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We are not responsible for the conduct of any user on or off the App. Meeting people you connect with through the App is at your own risk. Please exercise your own judgment and take reasonable precautions when meeting strangers.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless 9Teese and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms, with or without notice. You may terminate your account at any time by deleting it within the App. Termination does not affect any rights or obligations that arose prior to termination.
14. Governing Law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles. You agree that any dispute relating to these Terms or your use of 9Teese will be resolved in the courts located in British Columbia, Canada, unless applicable consumer protection laws require otherwise.
15. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App or on this page with a new effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
